Securities Investment Fraud

In order to provide securities investment fraud, you must show that a broker or another professional in the securities industry either intentionally or recklessly misrepresented or omitted material facts that you relied on, resulting in damages to you. In other words, you lost money on your investments because you relied on your broker's intentional bad advice. Additionally, for some types of fraud claims, you must show direct or indirect evidence that you relied on the broker's misrepresentation or omission of fact. Direct evidence might constitute a prospectus statement that an issuer is more successful than it actually is. Indirect evidence might exist in the form of "fraud-on-the-market", a theory that assumes since the broker's misrepresentation artificially inflated the stock price, and, as a result, you bought the stock, then you indirectly relied on the broker's misrepresentation to the market as a whole. Either of these types of evidence is sufficient to show the reliance that is necessary to maintaining some types of securities investment fraud claims.
