Like the financial industry, the transportation industry is also susceptible to cases of fraud. For instance, freight broker fraud may occur when a fictitious freight broker contracts with a company in order to arrange for the delivery or shipment of goods. The freight broker collects the broker fee from the company, arranges for the goods to be shipped, and then fails to pay the trucking company or other interstate carrier for the shipment of goods. While there have been some cases in the news where major freight broker fraud has been criminally prosecuted, the reality is that the law provides little or no regulation for freight brokers. There are no background checks, and the only requirement for being listed on the Federal Motor Carrier Safety Administration website as a legitimate freight broker is a very small cash surety bond. As a result, it is largely up to companies and interstate carriers to check out their freight brokers prior to doing business with them.
